Polish Post: e-delivery – when will it start? We present the implementation dates following the announcement by the Minister.

On May 29, 2023, the Minister responsible for IT issued a notice setting a deadline for introducing the mandatory use of electronic delivery for public entities and newly registered entrepreneurs, in accordance with Article 155 of the Act. The obligation will come into effect on December 10, 2023.

In accordance with applicable law and the published announcement, the above-mentioned entities will be required to use electronic delivery in accordance with the list below.

Schedule for introducing the obligation to use the National Electronic Delivery System

Public entities

From December 10, 2023 – the date specified in the Minister’s announcement of May 29, 2023.

· Government administration bodies and budgetary units serving these bodies.

· Public authorities other than those mentioned in point 1, including state control and law enforcement bodies and budgetary units serving these bodies.

· The Social Insurance Institution and the funds managed by it, and the Agricultural Social Insurance Fund and the funds managed by the President of the Agricultural Social Insurance Fund.

· National Health Fund.

· Executive agencies, budgetary economy institutions, state earmarked funds, independent public health care facilities, public universities, the Polish Academy of Sciences and its organizational units, state and local government cultural institutions, other state or local government legal entities established under separate acts for the purpose of performing public tasks.

Local government units and their associations, as well as metropolitan associations and local government budgetary establishments (using the public registered electronic delivery service)

From 01/01/2025

· Public entities other than those mentioned above.

From October 1, 2029:

Local government units and their associations, as well as metropolitan associations and local government budgetary establishments (obligation to apply the provisions on the delivery of correspondence using the public hybrid service) Courts, tribunals, bailiffs, prosecutors, law enforcement agencies and the Prison Service.

Non-public entities

From December 10, 2023 – the date specified in the Minister’s announcement of May 29, 2023.

· Professions of public trust:

practicing lawyer;

legal adviser practicing the profession;

a tax advisor practicing the profession;

a restructuring advisor practicing the profession;

patent attorney practicing the profession;

notary practicing the profession;

counselor of the General Prosecutor's Office of the Republic of Poland performing official duties.

· Non-public entities entered into the National Court Register (KRS).

From March 10, 2024

· Non-public entities entered into the National Court Register (KRS) before December 10, 2023.

From January 1, 2024

· Non-public entities entered into the Central Register and Information on Economic Activity (CEIDG)

From September 30, 2025

· Non-public entities entered into the Central Registration and Information on Business (CEIDG) as of January 30, 2023, if they apply for any change

From September 30, 2026

· Non-public entities entered into the Central Register and Information on Business Activity (CEIDG) as of December 10, 2023.
